CLIENT TERMS OF SERVICE

These Client Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Quickhands Inc. (“Company,” “we,” “us,” or “our”) governing your access to and use of our platform (the “Platform”).

  1. DEFINITIONS
  • “Platform” refers to our website, mobile application, and related services through which Clients may engage independent contractors (“Taskers”) to perform services.
  • “Tasker” means an independent contractor who is available to be retained by Clients to perform tasks or services.
  • “User” includes both Clients and Taskers.
  • “Service Agreement” refers to the agreement formed between a Client and a Tasker for a specific task.
  1. ELIGIBILITY

To use the Platform, you must:

  • Be at least 18 years old;
  • Have the legal capacity to enter into binding contracts;
  • Use the Platform in compliance with applicable laws;
  • Provide accurate, current, and complete information when creating an account; and
  • Keep your login credentials confidential and not share access to your account.
  1. SERVICES

The Platform connects Clients with Taskers. We do not perform any services and do not employ or supervise Taskers. Your engagement of a Tasker forms a direct Service Agreement between you and the Tasker. We are not a party to that agreement.

  1. CLIENT RESPONSIBILITIES

By using the Platform, you agree to:

  • Independently verify the qualifications, licensing, and insurance (if applicable) of Taskers;
  • Treat Taskers with respect and comply with all applicable laws and regulations;
  • Not circumvent the Platform to engage Taskers outside the Platform; and
  • Use the Platform in good faith and only for lawful purposes.
  1. PAYMENTS
  • Payments must be made through our third-party payment service provider (“PSP”).
  • You authorize us to charge your payment method upon confirmation of task completion.
  • Payment includes:
    • Tasker’s service fee;
    • Platform service fee;
    • Trust & Support fee; and
    • Taxes and out-of-pocket expenses (if applicable)

Payments are non-refundable unless otherwise stated in our cancellation or refund policies.

  1. CANCELLATIONS AND REFUNDS
  • Cancellation terms may vary depending on the task type and timing.
  • A cancellation fee may apply if a confirmed task is canceled.
  • Refunds, if any, are issued at our discretion and in accordance with our Refund Policy.
  1. ACCEPTABLE USE POLICY

You agree not to:

  • Use the Platform for unlawful, harmful, or abusive activities;
  • Upload or transmit malware, harmful code, or infringing materials;
  • Misrepresent yourself or impersonate others; and
  • Circumvent the payment system or engage in fraudulent conduct.
  1. BACKGROUND CHECKS AND TASKER VERIFICATION

We may facilitate background checks or identity verification of Taskers through third-party providers. However, we do not guarantee their accuracy, completeness, or suitability. Clients are solely responsible for assessing whether a Tasker meets their requirements.

 

 

  1. RATINGS AND REVIEWS

Clients may leave ratings and reviews of Taskers. These ratings are based solely on user opinions. We do not verify, endorse, or guarantee the accuracy of any rating, review, or testimonial. You agree and acknowledge that Quickhands shall not be liable for any content posted by users.

  1. ASSUMPTION OF RISK

You acknowledge and accept the inherent risks involved in engaging with Taskers, including but not limited to the risk of property damage, personal injury, or dissatisfaction with the services. You agree that your use of the Platform and engagement with any Tasker is at your sole risk.

  1. DISCLAIMERS

The Platform is provided “as is” and “as available.”

We disclaim all warranties, express or implied, including the fitness, safety, or legality of services offered by Taskers. We make no warranties regarding the quality, legality, or fitness of any Tasker or task.

We do not guarantee the outcome or quality of any service performed by a Tasker.

We do not guarantee that the Platform will be uninterrupted or error-free.

 

 

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Quickhands Inc. shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:

  • Your use or inability to use the Platform;
  • The performance or non-performance of any Tasker; and
  • Unauthorized access to your personal data or account.
  1. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Quickhands Inc., its affiliates, and their respective officers, directors, employees, contractors, licensors, agents, and representatives (collectively, the “Indemnified Parties”) from and against any and all claims, demands, actions, liabilities, losses, damages, judgments, settlements, costs, and expenses (including reasonable legal fees and disbursements) arising out of or relating to:

  • Your access to or use of the Platform;
  • Your breach or alleged breach of these Terms or any applicable law or regulation;
  • Your violation of any rights of another party, including Taskers and other Clients;
  • Your interaction with any Tasker, including the performance or non-performance of any services;
  • Any content you submit, post, or transmit through the Platform;
  • Any dispute or issue between you and a Tasker, or you and any third party; and
  • Your negligence, misconduct, or fraudulent behavior.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.

  1. DISPUTE BETWEEN CLIENTS AND TASKERS

We are not a party to any Service Agreement between you and a Tasker. While we may, in our sole discretion, facilitate resolution, we do not guarantee outcomes and shall not be liable for any dispute between Clients and Taskers.

  1. TERMINATION

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for conduct that violates these Terms or is otherwise deemed harmful to the Platform or its users.

  1. GOVERNING LAW

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable therein. Any dispute shall be resolved in the courts of British Columbia.

  1. MODIFICATIONS

We may update these Terms from time to time. We will notify users of material changes by posting the revised version on the Platform or by email. Continued use after such notice constitutes acceptance of the new Terms.
